Depends on your definition of "legally". All of the patent claims are
techniques with a half a century of prior art and/or blatent
obviousness...

Do you really worry about whether using XOR is legal? No because the
patents are bogus. Same with mpeg4 except that there's a lot of money
pushing the lie that the patents are valid, and money speaks to
judges...
