I don't think it can be argued that !NewTek ever wanted to comply with the
GPL when they decided to distribute a binary based on FFmpeg and x264
source code. Therefore no contract ever came into effect between the
FFmpeg developers and !NewTek and therefore you cannot demand any
obligations that result from such a contract.
